U.S. Copyright Office Publishes Part 2 of AI Report, Offering Clarity on Copyright for Generative AI Outputs

On January 29, 2025, the U.S. Copyright Office released Part 2 of its Report on the legal and policy issues related to copyright and artificial intelligence (AI). In the report, the Copyright Office determined that a work created solely through AI is not copyrightable, but a work that combines human creativity with AI can be copyrighted, so long as there is a “sufficient” amount of human expression in that work i.e.if a human exercises creativity in arranging or modifying the output. The Office declined to establish a separate copyright registration framework for AI-created works, but offered new examples demonstrating how employing AI as a tool can fulfill the authorship requirements for copyright protection.
